SERVICE PROVIDED

SeriousSoftball.com provides a message board and access to administrative functions to the user, who is at least eighteen (18) years old, or is a minor over the age of thirteen (13) who has parental permission.

CONTENT RESTRICTIONS

The following content is not allowed on your message board:

• Racism
• Hatred
• Harassment
• Adult Content
• Obscene Material
• Nudity or Pornography
• Piracy, Hacking, or Warez
• Any Illegal Content
• Commercial Banner advertisements or revenue-generating links
• Any link to or any images from a site containing any material outlined in these restrictions
• Any content deemed offensive by SeriousSoftball.com

In addition, you may not use our services if your website contains any content outlined in this section.

NO UNSOLICITED EMAIL

Users that promote or use methods of spamming, or unsolicited bulk email, are not allowed to create or use a SeriousSoftball.com message board. Any reported incident of spamming, or any form of unsolicited email or newsgroup posting that includes a link to or references to your SeriousSoftball.com message board will result in IMMEDIATE termination of your SeriousSoftball.com account, and a ban from registering for any SeriousSoftball.com services. You may not directly solicit new visitors to your message board by any means of email communication.

SERVICE

Service is provided "as is." Although we will make every effort to provide this service with no interruptions, there may be unexpected downtimes, loss of data, or interruptions of service. SeriousSoftball.com shall not be responsible for any loss of business or ANY other damages you may suffer as a result of these interruptions or data losses.

SeriousSoftball.com reserves the right to remove or edit any message or adjust the settings of your account.

You will be subscribed to "SeriousSoftball.com Updates", which will inform you of account changes, scheduled downtimes, or new features. You may not opt out of receiving "SeriousSoftball.com Updates," due to their important nature.

You agree that SeriousSoftball.com will place advertisements on your message board, in exchange for the service provided. It is SeriousSoftball.com's sole discretion as to how many advertisements appear on your message board, and the form of these advertisements.

You agree to make every effort to monitor your message board for any content that violates these terms. Unmonitored boards are not allowed.

TERMINATION

SeriousSoftball.com reserves the right to remove your message board and account access, without warning, for any reason at its sole discretion.

In addition, your account may be removed without warning for any of the following reasons:

• Violation of any guideline in these terms.
• Inactivity for a period of more than 30 days. (Inactivity is defined as a period when no messages are posted to your message board)
• Failure to maintain an accurate email address with SeriousSoftball.com.
• Any attempt to defeat, disrupt, or degrade our advertisements.

MODIFICATION

SeriousSoftball.com reserves the right to modify this agreement at any time. You agree to regularly review these terms of service. Failure to remove your account within seven (7) days of any such changes constitutes your acceptance of the new agreement.

GENERAL TERMS

You agree to indemnify and hold SeriousSoftball.com harmless from any claim or demand, including but not limited to attorneys' fees, made by any party due to or arising from your message board, your violation of our terms or service, or your violation of the rights of another person.

You hereby certify that all posters to your message board are at least thirteen (13) years of age.

You agree that SeriousSoftball.com may release any or all membership information to proper governmental agencies or courts if we believe you have committed illegal activities, if you violate our terms of service, or in the event that the information is subpoenaed.

SeriousSoftball.com shall have the sole discretion as to what what constitutes a violation of any of these terms.

If any condition in these terms of service is found unenforceable, SeriousSoftball.com reserves the right to modify the condition to comply with the law. All remaining conditions shall remain valid and enforceable.
